Privacy Policy

Information document pursuant to Article 13 of Legislative Decree No. 196 of June 30, 2003, and Article 13 of EU Regulation No. 2016/679

H.S. TRASPORT SRL (hereinafter “Data Controller”), as the data controller, informs you, pursuant to Article 13 of Legislative Decree No. 196/2003 (hereinafter “Privacy Code”) and Article 13 of EU Regulation No. 2016/679 (hereinafter “GDPR”), that your personal data will be processed in the following ways and for the following purposes:

1. Subject of the processing
   The Data Controller processes personal, identifying, and non-sensitive data (in particular, name, surname, tax code, VAT number, email, phone number – hereinafter “personal data” or “data”) provided during registration on the Data Controller’s website and/or when subscribing to the newsletter service offered by the Data Controller.

2. Purposes of processing
   Personal data is processed:

1. Without your explicit consent (Article 24 (a), (b), (c) Privacy Code and Article 6 (b), (e) GDPR), for the following service purposes:

   1. To allow registration on the website.

2. Only with your specific and separate consent (Articles 23 and 130 Privacy Code and Article 7 GDPR), for the following marketing purposes:

   • To manage and maintain the website;

   • To allow you to subscribe to the newsletter service provided by the Data Controller and any additional services you may request;

   • To fulfill pre-contractual, contractual, and fiscal obligations arising from existing relationships;

   • To fulfill obligations required by law, regulation, community legislation, or orders from authorities;

   • To send you newsletters, commercial communications, and/or promotional material regarding products or services offered by the Data Controller.

We inform you that if you are already our customer, we may send you commercial communications related to services and products of the Data Controller similar to those you have already used, unless you object (Article 130, paragraph 4 Privacy Code, Privacy Authority Provision 330 of 04/07/2013, EU Regulation 2016/679, Recital 171);

• Profiling: Analysis of the information you have provided and/or products you have purchased to better understand your preferences and offer you a personalized service.

3. Processing methods
   Personal data is processed both manually and electronically and/or automatically.
   The Data Controller will process personal data for as long as necessary to fulfill the above purposes and in any case for no longer than legally required.

4. Access to data
   Data may be made accessible for the purposes of Article 2.A) and 2.B) to:

• Employees and collaborators of the Data Controller or companies within H.S. TRASPORT SRL;

• Companies within the H.S. TRASPORT SRL group or third parties (e.g., providers for website management and maintenance, suppliers, banks, professional offices, etc.) that carry out activities on behalf of the Data Controller as external data processors.

5. Data communication
   Without explicit consent (pursuant to Article 24 (a), (b), (d) Privacy Code and Article 6 (b), (c) GDPR), the Data Controller may communicate your data for the purposes of Article 2.A) to supervisory bodies, judicial authorities, and any other subjects to whom communication is mandatory by law.
   Your data will not be disseminated.

6. Data transfer
   The management and storage of personal data will occur on servers located within the European Union of the Data Controller and/or third-party companies duly appointed as Data Processors.
   Currently, the servers are located in Italy.
   Data will not be transferred outside the European Union. However, if necessary, the Data Controller has the right to relocate the servers within Italy and/or the EU and/or non-EU countries.
   In this case, the Data Controller ensures that the transfer of data outside the EU will be done in compliance with applicable legal provisions, entering into agreements that guarantee an adequate level of protection and/or adopting the standard contractual clauses provided by the European Commission.

7. Nature of data provision and consequences of refusal to respond
   Providing data for the purposes of Article 2.A) is mandatory.
   Without this data, we cannot guarantee registration on the website or the services referred to in Article 2.A).
   Providing data for the purposes of Article 2.B) is optional.
   You may choose not to provide any data or to later withdraw your consent for the processing of data already provided:

• In this case, you will not be able to receive newsletters, commercial communications, and promotional material related to services offered by the Data Controller.

8. Rights of the data subject
   As a data subject, you may exercise the rights set out in Article 7 of the Privacy Code and Article 15 of the GDPR, specifically:

• Obtain confirmation of the existence or non-existence of personal data concerning you;

• Obtain information on the purposes, methods, logic applied to electronic processing, data of the Data Controller and processors, and the subjects to whom the data may be communicated;

• Obtain updates, corrections, integration, deletion, anonymization, or blocking of data processed in violation of the law;

• Object, for legitimate reasons, to the processing of data, even if pertinent to the purpose of collection;

• Object to the processing for direct marketing purposes using automated and/or traditional methods.
  These rights can also be exercised partially.

Where applicable, you also have the rights referred to in Articles 16-21 GDPR (rectification, erasure, restriction, portability, opposition), as well as the right to lodge a complaint with the Data Protection Authority.

9. How to exercise your rights
   You can exercise your rights by sending:

10. Minors
    This site and the services of the Data Controller are not intended for minors under 18 years of age, and the Data Controller does not knowingly collect personal information about minors.
    If information about minors is unintentionally collected, the Data Controller will delete it promptly upon request from the users.

11. Data Controller, processor, and persons in charge
    The Data Controller is H.S. TRASPORT SRL.
    The updated list of processors and persons in charge of the processing is kept at the Data Controller’s headquarters.

In accordance with the EU e-Privacy Directive and Privacy Authority Provision 229 of May 8, 2014, the use of cookies to collect your data is allowed only with your consent. To this end, we provide you with the following information regarding the use of cookies on our website.

What are cookies and why are they used?
